ChessBase forced to cease Internet broadcasting of the Topalov-Kamsky match

The scandal was close to being referred to the German court!

(26 February 2009, Sofia) The German chess site „ChessBаse” was forced to cease the live broadcasting of the games of the match between World Cup candidates Veselin Topalov and Gata Kamsky. Without permission from the Bulgarian Chess Federation (BCF) the Germans broadcast the first four games on the global network in spite of the warning published to that effect by the organizers on the official site of the match wccc2009.com.

The scandal was close to being referred to the German court, when BCF hired the labour law attorney Reiner Polzin from Berlin to defend its interests. On 20 February the legal defender sent a letter of warning to the owners of ChessBase Mathias Wüllenweber and Reiner Woisin. „On behalf of and with the power of attorney granted to me by my client I am hereby warning and inviting you to return, duly signed, the attached Declaration to Cease and Desist and Declaration of Commitment by fax by 12 o ‘clock of 21 February 2009. Otherwise I will apply for injunctive action against ChessBase” says Polzin in his letter. Immediately afterwards the site ceased live broadcasting and two days later the company declared, through their lawyers, that they “undertake vis-a-vis the Bulgarian Chess Federation to cease and prevent live broadcasting on the Internet, and more specifically on the server of ChessBase GmbH, of the games of the Topalov-Kamsky chess tournament, held in February 2009.”

„This is a precedent in the world of chess and we are grateful to attorney Polzin for his assistance”, commented BCF president Dr. Stefan Sergiev – This case will serve as a lesson to everybody who violates the copyright law.”
